General Terms and Conditions of Sale and internal regulations of the accommodation “LE COSY PERPIGNAN CENTRE”

1 – PREAMBLE
The CUSTOMER declares that he has full legal capacity to commit to these General Terms and Conditions of Sale, i.e. to be at least 18 years old and not to be under guardianship or curatorship. The CUSTOMER declares that he is reserving services on a personal and private basis, excluding professional resellers.
2 – DEFINITIONS
A – the CUSTOMER
The CUSTOMER is a person entering the site or making a reservation for the COSY PERPIGNAN CENTRE on the dates defined by him.
B – THE SELLER is L’E.I MOON SERVICES, SIRET N° 48953766200038
with legal domicile at 5 rue du plateau in Clichy-sous-Bois (93390). L’E.I MOON SERVICES is the owner of COSY PERPIGNAN CENTRE; it may be represented by agents chosen by it to ensure the follow-up of reservations and/or the reception of the CUSTOMER. Any communication must be sent to it by message on WhatsApp at +33 6 83 39 76 42 and copied by email to lecosyperpignancentre@gmail.com
C – LE COSY PERPIGNAN CENTRE
is a 55 m2 T3 apartment with a maximum capacity of 6 people located on the 3rd floor with elevator of the Résidence Royal Roussillon and composed of: – an entrance opening onto a living room with 3 coffee tables, 2 of which are metal and 1 in folding wood, a bar counter and 6 high stools, a 200×190 sofa bed, 1 white IKEA wall-mounted shoe cabinet, 1 WIFI router and 1 5G key; 1 2000 W convector and an electric fireplace, 1 Westinghouse 5-blade fan with adjustable light and its remote control, 1 bell lamp and hanging lights; curtains (4) and manual exterior blinds – a fitted kitchen open to the living room with electric oven, electric cooker and hood, toaster, Nespresso coffee machine, kettle, cupboards and complete crockery, kitchen utensils, mixer, immersion blender, pressure cooker for rice, washing machine, LED strip light and its remote control; – two bathrooms with mirrors, 750 W towel dryer, shower and shower curtain, and toilet; -two bedrooms: “La Catalane” with a Queen size bed of 160×200, its covers, sheets, duvet, blankets, pillows (2) and cushions (4), bedside lamp (1), curtains (2), manual exterior blinds, 2 shelving units, wall-mounted shoe cabinets, rectangular wall mirror, refrigerator, microwave oven, desk, chair and desk lamp and connected TV with WIFI and ORANGE decoder box, 2 luggage racks, 1 electric convector, 1 Westinghouse 5-blade fan with adjustable light and its remote control, connected lock; and “L’Occitane” with a Queen size drawer bed of 160×200 its covers, sheets, duvet, blankets, pillows (2) and cushions (4), curtains (2), manual exterior blinds, 1 shelving unit, refrigerator, microwave oven, kettle, desk, chair and desk lamp and connected TV with WIFI and ORANGE decoder box, storage cupboard, 1 electric convector, 1 Westinghouse 5-blade fan with adjustable light and remote control, connected lock; – a corridor with a storage cupboard and ceiling light; note that the owner will be able to store his supplies and replacement linen in locked bags which the CUSTOMER will not be able to claim access to Access to the apartment is (according to the SELLER’s instructions) via a key box installed outside the apartment for independent arrival until 10 p.m.
3 – CONTENT
These conditions apply to all services and sales of products offered on the website www.le-cosy-perpignan-centre.com They are automatically made available to the CUSTOMER on the home page of the website under the link “Internal regulations” The fact of placing an order implies the CUSTOMER’s full and unreserved acceptance of these T&Cs. These T&Cs may be modified at any time, without notice and without prior notification. These modifications will not apply to reservations made previously. Only the T&Cs in force at the time of the reservation are binding on the CUSTOMER. The CUSTOMER acknowledges having read and accepted these T&Cs.
4 – SETTLEMENT AND PAYMENT
The CUSTOMER guarantees that he is fully authorized to use the means of payment provided for the payment of his order and that it provides access to sufficient funds to cover all costs resulting from the purchase of his service. The promotional offers proposed by the SELLER cannot be combined with each other. Unless there is a specific promotional offer, the applicable rates are those appearing on the website where the reservation was made, in effect at the time of the reservation. The published public rates are subject to change without notice. The prices indicated are displayed in euros, including all taxes, and are only valid for the dates indicated on the booking confirmation, they include tourist tax and VAT (if applicable). The CUSTOMER receives a booking confirmation by email or SMS following their order. Confirmation of the CUSTOMER’s booking by THE SELLER is subject to receipt of the price of the services and receipt of a copy of the CUSTOMER’s identity document, which will be requested after payment. The booking confirmation summarizes the services ordered and the corresponding prices. Payment is made by credit card (Carte Bleue, Visa, Master Card/Eurocard) of which the holder is the reserving party. In accordance with Article L133-8 of the Monetary and Financial Code, and unless otherwise provided by law, the payment service user cannot revoke a payment order once it has been received by the payer’s payment service provider. Payment of the amount of the stay corresponding to the service at the time of booking is made in full by credit card on the COSY PERPIGNAN CENTRE website A non-debited security deposit of €300 will be requested in the form of a credit card imprint when booking online. The bank imprint has no impact on the customer’s bank limits. Any departure after the authorized time will be charged €20 per additional hour
5 – KEY DELIVERY / ENTRY INTO THE PREMISES / EXIT (CHECK-OUT)
Entry into the premises will take place: – from 3:00 p.m. to 10:00 p.m. – departure before noon The SELLER may, at its sole discretion, offer an automated check-in via a connected key box installed to the right of the entrance door of the accommodation. A unique temporary code valid only for the duration of the CUSTOMER’s stay will be sent to them on the day of their arrival. The SELLER or its agents may receive the CUSTOMER to carry out the check-in and give them the key. Beyond the arrival times mentioned above and except in cases of force majeure, the CUSTOMER’s failure to appear (“No show”) will be considered definitive and access to COSY PERPIGNAN CENTRE revoked. The CUSTOMER undertakes to notify the SELLER or its agents of their exact arrival time by SMS or WhatsApp to the number appearing on the booking confirmation one hour before. The CUSTOMER will find a welcome booklet within the accommodation to facilitate the occupation of the premises and the use of the accessories provided. When leaving, he will check that the doors and windows are closed, the electric radiators or fans are turned off and that he has not forgotten anything. If the SELLER is absent for his departure, he will lock the door and put the key back in the key box. PLEASE NOTE: any departure after noon will invalidate the opening code for the key box. The CUSTOMER will notify the SELLER by message once this procedure has been completed and if he has noticed or encountered a problem during his stay.
6 – INVENTORY OF FIXTURES and inventory of furniture and supplies
LE COSY PERPIGNAN CENTRE will be deemed to be in perfect condition of cleanliness and comfort, its electronic and electrical equipment in perfect working order, its furniture functional and in perfect condition upon the arrival of the CUSTOMER. THE SELLER will provide the CUSTOMER with bed linen and household linen at no extra charge (sheets, pillows, blankets, kitchen towels, hand towels, shower gel, shampoo, dishwashing liquid and cleaning products) The CUSTOMER must send the SELLER any details or disputes regarding the inventory of fixtures by SMS or email no later than 2 hours after arriving on the premises. Cleaning is included in the rental price. However, in the event of proven abuse (with supporting photos), a supplement for damage may be retained on the amount of the deposit of a minimum amount of €100.
7 – RENTAL SERVICES
The rates displayed by default apply for up to 4 people. Beyond 4 and up to 6 people, an additional charge of €15 per person per night will apply. The CUSTOMER will ensure that the number of people is correctly indicated when booking in order to allow the automatic calculation of the final rate and establish the exact amount of tourist taxes. OPTIONS NOT INCLUDED IN THE BASIC SERVICE – PETS (*) are allowed for a supplement of €50 per animal per stay. The CUSTOMER will inform the SELLER when booking the number of pets they wish to stay with. (*) Only dogs and cats are allowed during the stay
8 – OCCUPANCY RULES

LE COSY PERPIGNAN CENTRE has internal regulations detailed in this clause, which the CUSTOMER undertakes to read upon booking and to comply with. The COSY PERPIGNAN CENTRE has a maximum capacity of 6 people. The CUSTOMER agrees to respect the limit of the capacity. Any transgression of this rule will be at the risk and peril of the CUSTOMER who remains solely responsible for the occupants of the place during its rental. The CUSTOMER must return the accommodation including all its furniture and accessories in the condition in which he found them upon arrival.
The CUSTOMER acknowledges being responsible, not only for his own acts or omissions but also for those of any occupant on his behalf. The CUSTOMER will send a photocopy of his valid identity document as well as a certificate of home/holiday insurance for him and all occupants of the COSY PERPIGNAN CENTRE by email 24 hours maximum before the date of the reservation. The CUSTOMER agrees to leave the premises at the end of the allotted time. Failing this, the SELLER reserves the right to charge any excess time for occupying the premises, at a rate of €20 per additional hour. The CUSTOMER will be liable to the SELLER for all acts or costs inherent thereto. Pets are allowed at a supplement of 50 Euros per stay and per animal. The CUSTOMER is responsible for any damage caused to the furniture by his animals NAC (New Pets) are not allowed. Smoking and vaping are permitted inside and outside the COSY PERPIGNAN CENTRE with the exception of the bed area and the sofa where smoking is strictly prohibited (risk of burns and fire in the curtains, curtains and bed linen for the bedrooms, and risk of triggering the fire alarm). The CUSTOMER is liable to a charge of €200 in the event of damage to bed linen, armchair fabrics, curtains and other textiles that have been burned by cigarette butts.

No party may take place after 10 p.m. The CUSTOMER agrees not to invite any person other than the persons included in the rental, the SELLER reserving the right to intervene if necessary. In any event, the CUSTOMER agrees to use the suite and the services as a responsible adult. Any behavior or remarks contrary to good morals or public order will lead the SELLER to ask the CUSTOMER to leave the premises, without delay, nor reimbursement or compensation of any kind. The practice of a professional activity or contrary to the laws and regulations in force in France and to good morals, is strictly prohibited, as is any filming of erotic or pornographic films. The consultation of websites prohibited in France as well as illegal downloading are prohibited. The CUSTOMER retains full and entire responsibility for his actions in this matter. The CUSTOMER must make reasonable use of the Internet network made available to him. No downloading of films in VOD is authorized under penalty of overcharging.
The SELLER will systematically check all the furniture in the apartment and the accessories made available to the CUSTOMER when they leave the premises. If it appears that the CUSTOMER has damaged one of the items, the amount of the repair or replacement of the property will be invoiced to them as of right. A
photograph of this item will be given to them and will constitute proof of this damage. The CUSTOMER acknowledges having to pay the repair costs inherent to the damage claimed, upon receipt of the complaint. The amounts will be due upon receipt of the complaint letter, which will automatically incur interest at the legal rate, in addition to a conventional interest of 5% of the amount due. In any event, the SELLER cannot be held responsible for the actions of the CUSTOMER or any occupant under their responsibility. The SELLER cannot be held responsible for the proper functioning of the elevator. SELLER may access, preserve and disclose CUSTOMER information if it has a legal obligation to do so or if it believes in good faith that it is reasonably necessary to respond to claims or comply with any legal process, for fraud prevention purposes. SELLER has the right to investigate and take legal action for any violation of the conditions of occupancy, to the extent permitted by law.
In addition, the SELLER reserves the right to remove or prevent access to all or part of its site in the event of a violation of these general terms and conditions of sale. The CUSTOMER acknowledges that the SELLER has no obligation to monitor the CUSTOMER’s access or use of the site and services, nor to review, remove or prevent access to the site, but that it has the right to do so in the context of operating and improving the site and services, to ensure that the CUSTOMER complies with the conditions, to comply with applicable law or the decision of a court, administration or government agency, to respond to content that it considers harmful or as described in these conditions. In addition, penalties may be charged to the CUSTOMER and deducted in particular from its deposit, at the discretion of the SELLER. The CUSTOMER will pay a penalty of 20% of the amount of their order. 

9 – FORCE MAJEURE
The SELLER cannot be held responsible for the non-execution or poor execution of the reservation in the event of force majeure, in the event of an act of a third party or an act of the CUSTOMER. Indeed, in the event of force majeure or unforeseeable circumstances (such as mandatory work or work related to exceptional circumstances), the SELLER reserves the right to cancel the order placed by the CUSTOMER and therefore undertakes to provide a full refund, without additional costs to the CUSTOMER within 14 days of the cancellation notice given to the CUSTOMER.
10 – INSURANCE AND LIABILITY
The SELLER cannot be held responsible in the event of non-compliance with the legislation, theft, damage or loss of personal effects of the CUSTOMER or any occupant on his behalf during the contract binding the parties. The accommodation has professional insurance covering its activities. The CUSTOMER is personally responsible for his personal civil liability coverage, which he is presumed to hold (including a holiday clause) on the day his order is regularized. The CUSTOMER acknowledges responsibility for the use of all products or materials made available to him.
11 – EXTERNAL SERVICE PROVIDERS
If the payment was made on a site other than that of COSY PERPIGNAN CENTRE, the applicable booking and payment terms and conditions are those of said site, but these internal regulations remain the same.
12 – CHANGES BY THE CUSTOMER
For any change involving the removal of one of the reserved services, the amount of the initial order remains due.
13 – CANCELLATION CONDITIONS BY THE CUSTOMER
The CUSTOMER is reminded that they do not have the right of withdrawal provided for in Article L. 121-20 of the Consumer Code. Payment is total and final upon reservation. – However, a full refund is possible for cancellations made within 24 hours of booking, if the arrival date falls within 30 days or more. – Reservations are non-modifiable and non-refundable
14 – RESPECT FOR PRIVACY
The personal information requested from the CUSTOMER is necessary for processing his/her reservation. In the absence of information, the SELLER will not be able to process the reservation. The CUSTOMER may write to COSY PERPIGNAN CENTRE, whose contact details are indicated on the “Contact” page, to exercise his/her rights of access, opposition for legitimate reasons or without reason with regard to prospecting and rectification and with regard to information concerning him/her and subject to processing by the SELLER, under the conditions provided for by the law of January 6, 1978. The information that the CUSTOMER communicates to the SELLER when placing his/her order is not transmitted to any third party. This information is considered by the SELLER to be confidential. It is used only by the SELLER’s internal services for processing the CUSTOMER’s order and to strengthen and personalize the communication and service offering reserved for the SELLER’s customers. The CUSTOMER has the option to expressly consent to receiving direct marketing in the form of e-mail or postal mail. The CUSTOMER has the option to object, by e-mail or by registered mail with acknowledgment of receipt, to the use of data concerning him/her for prospecting purposes, in particular commercial.
15 – INTELLECTUAL PROPERTY
All texts, images and sounds reproduced on the website www.le-cosy-perpignan-centre.com is reserved under intellectual property law and for the entire world. These T&Cs do not entail any transfer of any kind of intellectual property rights on the elements belonging to the SELLER or rights holders such as photographs, images, literary texts, artistic works, brands, graphic charters, logos for the benefit of the CUSTOMER. The Internet user who has a personal website and wishes to place, for personal purposes, on his site a simple link directly to the home page of COSY PERPIGNAN CENTRE must obtain the prior and express authorization of the SELLER to establish this link. In any event, hypertext links referring to the COSY PERPIGNAN CENTRE website must be removed at the first request of the SELLER.
16 – MEDIATION
In accordance with articles L.616-1 and R.616-1 of the Consumer Code, L’E.I MOON SERVICES has set up a consumer mediation system under member number 11879. The selected mediation entity is: CNPM – MEDIATION – CONSOMMATION.
